Welcome to Daubaria. These Terms of Service (“Terms”) govern your access to and use of the Daubaria mobile application and any related services (collectively, the “Service”), developed and managed by OneVidaria Digital. By downloading, accessing, or using Daubaria, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

Daubaria is a modern digital card-daubing utility application designed for entertainment and organizational purposes. Version 1.0.0 currently supports the Daub 75 format, with subsequent formats (such as Daub 52) scheduled for future release.

• Strictly a Digital Utility (Not a Gambling Platform): Daubaria is entirely a software tool. We do not host, sponsor, or facilitate real-money gambling.
• No Financial Transactions for Gameplay: The Service does not process, hold, or distribute buy-ins, entry fees, wagers, or prize payouts (whether digital currency or cash-on-hand) for any games hosted by users.

2. Eligibility & Account Registration

Age Requirement (18+): The Service is strictly limited to users who are eighteen (18) years of age or older. By registering an account via your email and password, you represent and legally warrant that you meet this age requirement. Any account found to belong to an underage user will be immediately terminated.

Account Security: You are responsible for safeguarding your password and for all activities that occur under your account.

3. User Independence and Host Responsibilities

Users may utilize Daubaria to host their own private or public rooms. When doing so, the “Host” acts entirely independently of OneVidaria Digital.

• Third-Party Prizes: Any prizes, rewards, or out-of-pocket cash pots offered by a Host are solely the responsibility of that Host. Daubaria management has no connection to, does not endorse, and will not be held liable for the fulfillment of any off-platform promises or financial agreements made between Hosts and players.
• Compliance with Local Laws: Hosts are solely responsible for ensuring that their use of the Daubaria utility complies with all applicable local, state, and national laws regarding sweepstakes, giveaways, and gaming.

4. Prohibited Conduct and Anti-Gambling Policy

You agree not to use the Service to engage in any illegal conduct. Specifically, users are strictly prohibited from:

• Using Daubaria to facilitate, operate, or participate in illegal gambling, unlicensed betting rings, or unregulated lotteries.
• Charging mandatory entry fees or “buy-ins” in exchange for the chance to win a real-money prize, where such activity violates local gaming laws.
• Falsely representing that Daubaria or OneVidaria Digital is a sponsor, partner, or financial backer of any user-hosted event or prize pool.

Daubaria reserves the right to immediately suspend or terminate any account found to be violating these rules and may report illegal activities to the appropriate authorities.

5. Community Conduct & Reporting

Daubaria includes in-room chat and other social features. To keep the community safe and welcoming, you agree not to post, transmit, or share any content that is harassing, hateful, threatening, defamatory, sexually explicit, illegal, or otherwise objectionable, and you agree not to spam, advertise without authorization, or impersonate any person or entity.

We provide block and report tools directly within the app so you can manage your experience and flag inappropriate behavior. Our team reviews submitted reports, and violations of this code of conduct may result in content removal, suspension, or permanent termination of your account.

You are solely responsible for the content you submit through the Service and for ensuring that it complies with these Terms and all applicable laws.

6. Platform Operations and Room Management

Inactive Room Lifecycle: To ensure optimal server performance, Daubaria employs an automated room management system. If a hosted room becomes completely inactive or idle, a 20-minute countdown timer is triggered. If the room remains inactive when the timer expires, the room will be automatically deleted. This mechanism does not limit or interrupt active gameplay.

AI Bots: Daubaria utilizes AI bots to simulate multiplayer environments. These bots are provided for entertainment and room population purposes and do not represent real-money competitors.

7. Platform Purchases and Monetization

Daubaria offers premium hosting tiers and platform customization options. These features are strictly platform utility upgrades and are not associated with gameplay wagers.

• Room Sponsorships: Users may purchase a Room Sponsorship to secure a pinned, featured placement on the main app lobby for a duration of twenty-four (24) hours.
• VIP & Investor Tiers: Users may upgrade to VIP Hosting tiers for expanded capacity or purchase Investor Tier cosmetics (such as unique card patterns and UI flair).
• Billing: All in-app platform purchases are processed securely through the Google Play Billing system. All sales are final, non-refundable, and non-transferable unless required by law.

8. Limitation of Liability

To the maximum extent permitted by law, OneVidaria Digital and the Daubaria management team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:

• Your use of or inability to use the Service.
• Any conduct, disputes, or financial losses occurring between users (Hosts and players).
• The failure of a Host to distribute promised out-of-pocket prizes or the failure of a player to pay agreed-upon off-platform entry fees.

Daubaria provides the digital utility “as is.” How you use it is your responsibility.

9. Indemnification

You agree to indemnify, defend, and hold harmless OneVidaria Digital, its developers, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your violation of these Terms or your operation of user-hosted games.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal actions or proceedings arising out of these Terms shall be brought exclusively in the courts located in Las Piñas, Metro Manila.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the “Last Updated” date at the top of this document or via in-app notification. Your continued use of Daubaria after any changes constitutes acceptance of the new Terms.
